These Terms of Service ("Terms") govern your access to and use of the Social Posting API and any related websites, tools, and documentation (collectively, the "Service") operated by Social Posting API ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

The Service provides an application programming interface (API) and related tools that allow developers and their end users to schedule, publish, and manage content across third-party social media platforms, including TikTok, Instagram, YouTube, and others (each, a "Platform"). The Service acts as an intermediary that transmits content and requests to these Platforms on behalf of authenticated users.

2. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your API credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your credentials.

3. Connecting Third-Party Platforms

To publish content, you or your end users must authorize the Service to access one or more Platforms through their official authentication (OAuth) flows. By connecting a Platform, you represent that you are authorized to do so and that you will comply with that Platform's own terms of service and developer policies, including but not limited to the TikTok Terms of Service and applicable TikTok developer policies. Your use of each Platform through the Service remains subject to that Platform's terms.

4. Acceptable Use

You agree that you will not use the Service to:

• Publish or distribute content that is unlawful, infringing, defamatory, harassing, hateful, or otherwise objectionable;
• Violate the terms, policies, or rate limits of any connected Platform;
• Post spam, misleading, or deceptive content, or engage in inauthentic or automated abusive behavior;
• Infringe the intellectual property, privacy, or other rights of any third party;
• Attempt to gain unauthorized access to the Service, other users' data, or any Platform;
• Reverse engineer, resell, or misuse the Service in a manner not expressly permitted by these Terms.

5. Content Ownership & Responsibility

You retain ownership of the content you submit through the Service. You are solely responsible for the content you publish and for ensuring you have all necessary rights and permissions. You grant us a limited license to process, transmit, and store your content only as necessary to provide the Service.

6. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service depends on third-party Platforms whose availability, APIs, and policies are outside our control and may change at any time. We may modify, suspend, or discontinue any part of the Service at our discretion.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that content will be delivered, published, or retained by any Platform.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Social Posting API and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms or any Platform's terms.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we are required to do so by a Platform or by law. You may stop using the Service at any time and disconnect your Platform accounts.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
